PERMANENT STAFF

TERMS AND CONDITIONS OF BUSINESS

This agreement is between the proprietors of DCL Recruitment and the Client (any person or any corporation, it's officers, employees or agents hereinafter referred to as "you" and/or "your company").

Engaging DCL Recruitment to carry out any of the functions described in this agreement will be taken as your acceptance of the Terms and Conditions set out herein.

DCL RECRUITMENT FEES

  • No fee is payable until we are successful in placing a suitable applicant with your company, with the exception of positions withdrawn by you as outlined overleaf under "SERVICE FEE".
  • When a DCL candidate accepts a position with your company you must notify us. On the date of commencement you will be invoiced for a placement fee based on a percentage of the annual salary of the successful candidate.
  • Payment is strictly 30 days from date of invoice.

OUR GUARANTEES

  • We offer a guarantee on all placements from the date of commencement of employment for a period of ONE WEEK FOR EVERY ONE PERCENT OF FEE. For example, a fee of 10% carries a 10 week guarantee period, a fee of 12% a 12 week guarantee etc. Should the employee not be suitable, DCL will provide a replacement or refund the fee.
  • This guarantee period is valid on the following basis:
      • Invoices are paid within 30 days of date of invoice. The guarantee becomes null and void if invoices are not paid within 30 days;
      • DCL is given the sole opportunity to provide a replacement candidate;
      • The cessation of employment is not due to change of job specification, redundancy, restructure, merger, company takeover or closure of business;
      • If a suitable replacement candidate cannot be found, DCL Recruitment will refund the placement fee, retaining $500 to be credited against your next permanent or temporary placement.

SERVICE FEE

  • In the event of a permanent position with a salary in excess of $50,000 being withdrawn by the Client after a period of two (2) weeks a service fee of $1,000 will be charged for administration and advertising costs.

GENERAL

  • All advertising will be at the expense and discretion of DCL Recruitment, unless otherwise negotiated and confirmed at the time of listing a specific job vacancy.
  • All information given to DCL Recruitment by your company and by our registered candidates will be considered confidential and handled accordingly by all parties.
  • If one of our candidates is referred by you to another company which subsequently employs that candidate, then your company will be liable to pay a full placement fee.
  • If you employ (or re-employ) any person whose initial introduction to you was through DCL Recruitment within 3 months of the initial introduction you will be required to pay a full placement fee.
  • While we endeavour to provide full and accurate information, DCL Recruitment accepts no liability for any claim of loss, expense, damage or delay however occasioned, including as a result of the negligence of DCL Recruitment, it's employees or agents.
  • If an employee is terminated within the guarantee period and is re-employed by you within 12 months from the date of termination, a full placement fee is payable.

Engaging DCL Recruitment to carry out any of the functions described in this agreement will be taken as your acceptance of the Terms and Conditions set out herein.

DCL RECRUITMENT FEES

  • You are only charged for the actual hours worked by the temporary employee. You do not pay for lunch breaks etc.
  • You pay one amount invoiced weekly (payable strictly within 7 days) and DCL Recruitment makes all associated payments including payroll tax, superannuation and workers' compensation.
  • As we pay the temporary staff on a Monday to Friday weekly basis, and they complete a timesheet on this basis, all charges will be for a Monday to Friday week.
  • All rates quoted are based on relevant Awards and statutory charges, and are subject to changes. We will notify you of any such changes and variations to hourly rates.

    Please note: All rates to be negotiated at the time of listing the position. This will be based upon the required skills.

OUR GUARANTEES

  • In the event of a temporary employee being unsuitable or unsatisfactory, provided we are notified within the first four (4) hours of commencement, no charge will be made.
  • To ensure your satisfaction, and to maintain the standard of our service, all temporary employees are monitored in every assignment.

AWARD

Temporary staff employed by DCL Recruitment work under the conditions of the relevant Award. In accordance with this the following points should be noted.

  • Each temporary booking is subject to a minimum charge of four (4) hours.
  • Overtime payments are applicable when a temporary employee works more than 8 hours in one day, or more than 38 hours in a working week, or for work performed on weekends and public holidays plus meal allowances where applicable. It is your responsibility to ensure that overtime is authorised and consideration is made of the resultant expense.
  • After continual employment for 12 months or more with the same host employer, temporary staff are entitled to sick leave with pay and payment for public holidays if the employee works the business day before and the business day after the public holiday. The client is charged at cost, being the employee's pay rate plus statutory costs, excluding any margin.
  • As the Award is subject to changes and alterations we will notify you of any changes.
  • Please speak with your Consultant for specific Award details.

TEMPORARY BECOMING PERMANENT

  • As the temporary staff we provide are employed by DCL Recruitment the decision for you to employ them on a permanent basis will be understood as an acceptance to pay a permanent placement fee. The fee will be based on the length of service with you as a temporary employee, as follows:
    Less than 3 months Full fee, full guarantee
    3 to 6 months 50% fee, 50% guarantee
    6 to 12 months 25% fee, 25% guarantee
    12 months or more NO FEE, no guarantee

  • All fees based on relevant permanent placement fees as stated in the current Permanent Terms and Conditions of Business.
  • If you employ a person who was introduced to you as a DCL Recruitment temporary employee within 3 months of the completion of their assignment with your company, a permanent placement fee will be payable.

  • If an employee is terminated within the guarantee period and is re-employed by you within 12 months from the date of termination, a full placement fee is payable.
